Terms & Conditions
General
- This website and all of its sub domains (the “Site”) are owned and operated by Packgens. Any reference to “we”, “us” or “our” refers to Packgens, and the services on the Site are offered and provided by us.
- The terms “you”, “your” and “customer” refer to the person who uses or intends to use the services on this Site, whether chargeable or not, subject to these Terms of Use.
- By placing an order, requesting a quote or otherwise using the Site, you confirm that you accept these terms and that you have the authority to accept them on behalf of any business you are ordering for.
Quotations and orders
A quotation is an invitation to order and is valid for thirty days unless it states otherwise. An order is accepted only once we confirm it in writing and have received cleared payment or an agreed deposit. We may decline an order where artwork, specification or delivery requirements cannot be met.
Artwork and proofs
- You are responsible for the accuracy of everything you supply, including text, images, barcodes, logos and any trade marks, and you confirm that you hold the rights to use them.
- We supply a digital proof before production. Nothing goes to press until you have approved that proof, and approval is taken as confirmation that the content, spelling and specification are correct.
- Printed colour may vary slightly from what a screen shows. Where exact colour matters, ask us for a physical proof before approving the run.
Prices, payment and cancellation
- Prices are quoted exclusive of VAT unless stated, and are based on the specification and quantity given at the time of quoting.
- Because every order is manufactured to your specification, an order cannot be cancelled once it has entered production.
- Where a run has not yet started, we will refund any amount paid less costs already incurred on design, plates or tooling.
Delivery
Delivery dates are estimates given in good faith and run from proof approval rather than from the order date. We are not liable for delays caused by events outside our reasonable control. Risk in the goods passes to you on delivery; title passes once payment has cleared in full.
Quantity tolerance and quality
Manufacturing tolerances mean the delivered quantity may vary from the ordered quantity by a small margin, and we invoice for the quantity delivered. If any part of an order is faulty, tell us within seven days of delivery with photographs so we can reprint or refund the affected part.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability for any order is limited to the amount you paid for it, and we are not liable for loss of profit, loss of business or any indirect or consequential loss.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
